抄録 | 本稿は,LGBTをめぐる制度議論の動向を事例に取り上げ,法曹界の動きをとおして「中間組織」「公共性」「制度」について考察した。まず,コロナ禍における法曹界の趨勢を日本弁護士連合会と各地域の弁護士会に分けて人権問題への取り組み姿勢について概観し,人権と権利の諸相および権利の生成過程における裁判の役割について論じた。次に,LGBTをめぐる問題を世に問うた初の裁判事例となった「東京都府中青年の家事件」に焦点を当て,この裁判をとおして制度設計における中間組織の役割について議論した。そして,「東京都府中青年の家事件」以降のLGBT関連の裁判事例や中間組織の設立,法制度の整備を歴史的に観察し,その関連性を検討した。結論として,1)情報化社会における民主的討議の実現方法を探る試みとして, LGBTをめぐる議論を法曹界の活動と関連付けて観察・分析し,中間組織の持つ知見と有資格専門職能者とのつながりがもたらす新しい制度ニーズのアジェンダ化機能を制度設計に活かすこと,2)こうしたアジェンダ化機能は,人びとが熟議する場の実現が困難な状況において,共感(スミス)や共同善(ベラー)の醸成に資する手段となる可能性があること,3)民主主義の価値観が相対化され権威主義的支配の有効性も論じられる社会状況において,情報化社会ならではのリアルとオンラインを統合した公共性の意義と確立についてあらためて熟考する必要があること,を指摘した。This paper took up the trend of arguments for the legal system for lesbian, gay, bisexual, and transgender(LGBT)as a case and examined "intermediate organizations," "publicness, " and "Institutions" through the movement of legal circles. We investigated attitudes toward tackling human rights issues by the Japan Federation of Bar Associations and the bar association in each judicial district and examined the role of trials in various aspects of human rights and the process of establishing rights. Next, we focused on the Fuchu Youth House Rental Refusal in Tokyo, which was the first court case to appeal to the publicon LGBT issues and discussed the role of intermediate organizations in institutional design through this court case. We then reviewed historical court cases related to LGBT after the Fuchu Youth House Rental Refusal, the establishment of intermediate organizations, and the development of legal systems. Subsequently, we examined the relationships among these three areas. The results are as follows:(1)to realize democratic discussion in the information society, debates on LGBT must be examined and analyzed in conjunction with the activities of legal circles, and the function of setting the needs of a new system generated from the connection between knowledge held by intermediate organizations and those held by qualified professionals, as an agenda must be utilized in institutional design;(2)this agenda setting function may become the means to foster sympathy(A.Smith)and common good(R.Bellah), when a place for people to deliberate is difficult to realize; and(3)under the social circumstances in which democratic values have been relativized and the effectiveness of authoritarian control has been argued, the importance of establishing publicness, in which real and virtual worlds are merged through the Internet in the information society, must be reconsidered. |
